Interdepartmental Agreement

The amendment of constitutional provisions and air traffic regulations in 1991 paved the way for the expansion of civil-military cooperation. Regional civil and military services have been united in one operational and legal system. More than 50 agreements and regulations form the basis of this comprehensive cooperation.
Many people still find it difficult to understand how a civil air navigation service provider can adequately perform a military mission. The Interdepartmental Agreement concluded in 1991 between the Ministry of Defence and the Ministry of Transport laid the groundwork for all of above-mentioned civil-military agreements. It forms the basis of civil-military integration in Germany. It defines the principles of integration, tasks, responsibilities and special aspects in accordance with legal provisions.

The Interdepartmental Agreement includes the following individual aspects:
  • In peacetime, regional air traffic control shall be the responsibility of DFS
  • Transferred military staff shall be deployed in all important departments of the company on the basis of equal-opportunity employment contracts
  • DFS shall be responsible for training of operations personnel, even with regard to military tactical subjects
  • The Federal Ministry of Defence shall be included in the governance and supervision of DFS
  • DFS shall ensure flight inspection of military air traffic control facilities

Furthermore, the following aspects are of great importance:
  • Decree concerning the release of military staff from regular service to be transferred to DFS issued by the Federal Ministry of Defence
  • Regulation of cost reimbursements of services rendered by DFS for the Armed Forces
  • Agreement concerning the tasks in states of tension and defence
  • Arrangements with trade unions for emergency services to ensure military flight operations in the case of strikes

Today, transferred military and civil air traffic controllers work in accordance with operational regulations that have been harmonised for civil and military controllers. Everything from operational agreements with military units to the development of special procedures during exercises leads to further regulations.
