DFS welcomes the decision of the German Bundestag - Amendment to the German Constitution permits Single European Sky

DFS Deutsche Flugsicherung GmbH welcomes the decision of the German Bundestag voted by a vast majority to modify Article 87d of the German Constitution and further air traffic regulations.

Now the German Constitution as well as the German aviation legislation will be adapted to the regulations of the European Community to create a Single European Sky (SES). From the DFS perspective, the historic significance of the decision of the German Bundestag lies in the strong commitment to depart from the purely national concept of air traffic control to promote a borderless European air transport system. What the Members of Parliament have achieved is, on the one hand, to create legal certainty for air navigation services organisations operating in Germany. And, on the other hand, to take the first big step towards the creation of a Single Market in the air, by permitting cross-border cooperation in air traffic control based on European law.

Thus, when creating the Single European Sky, Germany will be able to apply those instruments provided under European law. This particularly includes the establishment of a functional airspace block that is to be created together with our neighbouring countries France, the Benelux States and Switzerland by the end of 2012. The functional airspace block will help to reduce interfaces and provide a sustainable basis for the cross-border cooperation along air traffic flows. The improved air traffic management will avoid unnecessary re-routing in European airspace in the future and thus decrease fuel consumption as well as aircraft engine emissions.

Furthermore, the German Bundestag has paved the way for the establishment of a Federal Supervisory Authority for Air Navigation Services which will ensure that the performance of air traffic control services and effective supervision are separated transparently.

DFS is confident that the adopted laws will also be supported by the Bundesrat in order to swiftly bring the legislation procedure to a close before the summer break.
