Legal framework

The statutory obligation of DFS is the safe, orderly and expeditious handling of air traffic, pursuant to Article 27c of the German Aviation Act (LuftVG). DFS is legally obliged to work towards protecting the population against unacceptable aircraft noise, pursuant to LuftVG article 29b, paragraph II. This includes the routes which are planned by DFS but put in place in an ordinance by the Federal Supervisory Authority for Air Navigation Services (Bundesaufsichtsamt für Flugsicherung - BAF) .

DFS uses the NIROS planning tool (Noise Impact Reduction and Optimisation System) to take noise exposure of an area into consideration when planning a new flight route. Apart from national and international provisions that must be considered, the results of this system are also included in the DFS decision-making process, as are the advice given by the Noise Abatement Commission in line with Article 32b of the German Aviation Act (LuftVG).

These commissions are formed for each airport where scheduled air services are provided and for which a noise abatement zone has been established in line with the Aircraft Noise Act, in order to advise the approval authority and the unit responsible for air navigation services about measures to reduce aircraft noise and air pollution.

The Noise Abatement Commission should include representatives of the local authorities situated in the vicinity of the airport which are affected by aircraft noise, as laid down in Article 32b, paragraph 4, of the German Aviation Act. Flight route regulations which are of particular importance for the protection of the population against aircraft noise are passed by the Federal Environment Agency in line with Article 32, paragraph 3, sentence 4, of the German Aviation Act.
