SES I
In March 2004, the legislative package SES I came into force. Besides a framework regulation describing the fundamental rules and parameters for the creation of a Single European Sky, this package includes three more regulations about the provision of air navigation services, the organisation and use of airspace and the interoperability of the European air traffic management network. This legislation is directly applicable in each EU Member State, i.e. it is equivalent to a national law. The framework regulation underlines the significance of the European Community joining the international organisation EUROCONTROL. Overlapping between these legislative international institutions is to be avoided as far as possible and concepts are to be coordinated. The Single European Sky is to be created in compliance with the obligations arising from this membership. The parameters of the International Civil Aviation Organisation (ICAO) will also be considered. The regulations are binding in their entirety and directly applicable in the EU. The objective of the regulation on the organisation and use of airspace is to create a more integrated operating airspace to accommodate the forecast traffic growth and to establish common procedures for design, planning and management ensuring the safe and efficient performance of cross-border air traffic management. The regulation on the provision of air navigation services defines common rules for performing these services. A uniform certification system was established to assure the quality of air navigation services. Certificates are issued by a national supervisory authority, which defines and regularly monitors the rights and obligations of air navigation service providers. Finally, the regulation on interoperability of the European air traffic management network aims at ensuring the compatibility of systems, constituents and procedures as well as the coordinated introduction of new technologies. All systems in operation are to meet the provisions stated in the annex to this regulation by 2011.
